Understanding the Insurance and Indemnity Language

in your Construction Contract

 

Description

Insurance requirements and indemnity language are found in every construction contract, but they are often misunderstood or overlooked. In this program, you will learn why they are in the contract and what they obligate you (or the parties you require them from) to do. We will review specific examples of good and bad language, and discuss real-life implications (including recent claims and case law) of how insurance requirements and indemnity provisions can affect property damage or bodily injury claims on a project.

 

Learning Objectives

  • Understand most commonly used insurance and indemnity language in construction contracts, including AIA form contracts
  • Learn to evaluate the specifics of the insurance requirements to make sure your company’s insurance is in compliance
  • Examine examples of troublesome contract language and learn how to negotiate around them
  • Learn to appreciate the impact of insurance and indemnity contractual language in the event of a construction defect of a construction site injury claim

 

Note: This is a live, in-person session.  However we are planning to record the session and make it available to participants afterwards. Stella Szantova Giordano, Attorney, Saxe Doernberger & Vita, P.C.

Stella Szantova Giordano is passionate about finding solutions for her clients, and to secure the best possible outcome for them. She assists clients with a variety of coverage issues and advises on risk transfer strategies. She is a member of the firm’s Cyber Coverage practice group, with a particular focus on US-EU data transfer issues.


While attending law school, Stella served on the Quinnipiac Law Review. She also externed at Henkel, an international consumer goods manufacturer, drafting and negotiating procurement contracts. There, she learned how important proper insurance coverage is for a business, and how to properly shift risk from the clients to vendors.

 

In 2015, Stella was the vice-chair of the Community Involvement committee of HYPE (Hartford Young Professionals and Entrepreneurs) where she organized hands-on volunteer and community service events. She was also a member of HYPE’s Executive Committee. She lives in Ridgefield, CT with her husband; loves traveling, cooking, and theater; speaks Slovakian, Czech, Russian, German, and recently started learning Spanish.

Continuing Educational Credit

Construction Institute is an AIA Registered Provider and a CCM Recertification Point Provider.  

 

Course attendees are eligible to receive 0.1 Continuing Education Units, 1 CCM Renewal Point, and/or 1 AIA Continuing Education Learning Unit, verified through certificates of attendance, which are sent to participants after completion of workshop and assessment.
